{"id":3480,"date":"2019-05-22T15:59:47","date_gmt":"2019-05-22T13:59:47","guid":{"rendered":"https:\/\/www.emagister.com.co\/blog\/?p=3480"},"modified":"2019-05-23T13:12:13","modified_gmt":"2019-05-23T11:12:13","slug":"que-ramas-del-derecho-existen","status":"publish","type":"post","link":"https:\/\/www.emagister.com.co\/blog\/que-ramas-del-derecho-existen\/","title":{"rendered":"\u00bfQu\u00e9 ramas del derecho existen?"},"content":{"rendered":"<p style=\"font-weight: 400;\"><span style=\"font-style: inherit; font-weight: inherit;\">Si no eres estudiante de\u00a0<\/span><a href=\"https:\/\/www.emagister.com.co\/carreras-universitarias\/carreras-universitarias-derecho-tematica-238.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">, es muy probable que no tengas tan claro que esta disciplina, definida seg\u00fan Castan Tobe\u00f1as como \u00abel sistema de normas fundadas en principios \u00e9ticos y susceptibles de sanci\u00f3n coercitiva, que regulan la organizaci\u00f3n de la sociedad y las relaciones de los individuos y agrupaciones que viven dentro de ella para augurar en la misa el consentimiento arm\u00f3nico de los fines individuales y colectivos\u00bb, tiene varias ramas.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-style: inherit; font-weight: inherit;\">En este post encontrar\u00e1s las principales\u00a0<b><strong style=\"font-style: inherit;\">ramas del derecho.<\/strong><\/b><\/span><\/p>\n<p>La primera divisi\u00f3n es la que separa el\u00a0<a href=\"https:\/\/www.emagister.com.co\/cursos-derecho-publico-kwes-3061.htm\"><b>Derecho p\u00fablico<\/b><\/a>\u00a0del\u00a0<a href=\"https:\/\/www.emagister.com.co\/cursos-derecho-privado-kwes-3059.htm\"><b>Derecho privado<\/b><\/a>. El p\u00fablico se encarga de regular las actividades del Estado y los organismos p\u00fablicos con los ciudadanos, es decir, cuando las partes en cuesti\u00f3n no tienen una posici\u00f3n de igualdad. Por su parte, el privado, se encarga de regular las relaciones entre individuos en igualdad de condiciones, y en este caso, puede llegar a haber m\u00e1s flexibilidad dentro de la legalidad.<\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-style: inherit; font-weight: inherit;\">\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Veamos las\u00a0subdivisiones del derecho p\u00fablico y el privado.<\/span><\/p>\n<p style=\"font-weight: 400;\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho p\u00fablico<\/span><\/strong><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/cursos-derecho-administrativo-kwes-1434.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho administrativo<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: es la normativa que regula la administraci\u00f3n del Estado, por tanto, se encarga de los posibles problemas que surjan entre las administraciones p\u00fablicas y los ciudadanos, es decir, entre el Estado en sus varias formas y los individuos. (Enlace: cursos de\u00a0<\/span><a href=\"https:\/\/www.emagister.com.co\/cursos-hacienda-publica-kwes-3259.htm\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho Administrativo Sancionador<\/span><\/a><span style=\"font-style: inherit; font-weight: inherit;\">)<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/cursos-derecho-constitucional-kwes-2981.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho constitucional<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: constituye el conjunto de normas que derivan de lo establecido por la Constituci\u00f3n, y los casos en los que se act\u00fae en contra de estas leyes constitucionales se rigen por este derecho.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/postgrado\/postgrado-derecho-internacional-tematica-242.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho internacional p\u00fablico<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: se encarga de regular las relaciones entre Estados y organizaciones internacionales. Por consiguiente, recoge valores compartidos para el mantenimiento de la paz y la cooperaci\u00f3n, y en este sentido, depender\u00e1 de la normativa legal de cada Estado.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/postgrado\/postgrado-derecho-penal-kwes-3058.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho penal<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: es el conjunto de normas que establecen las sanciones previstas para individuos que cometan un delito. Para ello, los delitos est\u00e1n claramente definidos seg\u00fan lo establecido por la norma.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/especializacion-derecho-tributario-tps-70437.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho tributario<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: es la rama del derecho que rige la Hacienda p\u00fablica, por tanto, se encarga de la creaci\u00f3n, recaudaci\u00f3n y liquidaci\u00f3n de los impuestos del Estado.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/postgrado\/postgrado-derecho-laboral-kwes-3004.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho laboral<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: es la rama del derecho p\u00fablico que recoge las relaciones entre los trabajadores y sus empleadores, define sus derechos y obligaciones, entre ellos, los convenios colectivos y el derecho a huelga. No obstante, esta rama tambi\u00e9n tiene que ver con el derecho privado, por el tema de los contratos de trabajo, salarios y\u00a0\u00a0vacaciones. En definitiva, es una de las ramas m\u00e1s amplias que recoge, adem\u00e1s, aspectos de derecho constitucional.<\/span><\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho privado<\/span><\/strong><\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/postgrado\/postgrado-derecho-mercantil-kwes-1608.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho mercantil<\/span><\/strong><\/b><\/a><span style=\"font-style: inherit; font-weight: inherit;\">: son las\u00a0normas que regulan la actividad de los comerciantes, las acciones comerciales y las relaciones jur\u00eddicas correspondientes. En este sentido, forma parte del derecho privado y act\u00faa como derecho empresarial.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/especializacion-derecho-internacional-privado-cursos-2782088.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho internacional privado<\/span><\/strong><\/b><\/a><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">:\u00a0<\/span><\/strong><\/b><span style=\"font-style: inherit; font-weight: inherit;\">esta normativa re\u00fane las normas vigentes para las relaciones jur\u00eddicas entre individuos sujetos a la normativa de diferentes Estados. Tiene como prop\u00f3sito determinar la ley y la autoridad competente para actualizar una relaci\u00f3n espec\u00edfica, en caso de que se genere alg\u00fan tipo de conflicto entre la normativa de dos o m\u00e1s pa\u00edses.<\/span><\/li>\n<li style=\"font-weight: 400;\"><a href=\"https:\/\/www.emagister.com.co\/postgrado\/postgrado-derecho-civil-kwes-3055.htm\"><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">Derecho civil<\/span><\/strong><\/b><\/a><b><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">:\u00a0\u00a0<\/span><\/strong><\/b><span style=\"font-style: inherit; font-weight: inherit;\">Hace parte del derecho privado y se encarga de regular, b\u00e1sicamente:<\/span>\n<ul>\n<li><span style=\"font-style: inherit; font-weight: inherit;\">la persona y sus derechos civiles: los m\u00e1s b\u00e1sicos, de los que goza todo individuo por existir.<\/span><\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit;\">el patrimonio: todos los bienes y obligaciones\u00a0de una persona individual.<\/span><\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit;\">las relaciones familiares: regula las relaciones entre individuos que deciden formar una familia, y las obligaciones que se derivan con respecto a otros individuos (com\u00fanmente, los hijos) y al patrimonio.<\/span><\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit;\">la trasmisi\u00f3n por causa de muerte de bienes y derechos: o sea, el derecho de sucesi\u00f3n.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><span style=\"font-style: inherit; font-weight: inherit;\">Es importante recordar que estas ramas son parte del \u00abderecho objetivo\u00bb (conjuntos de normas que regulan) y que existe tambi\u00e9n la acepci\u00f3n \u00abderecho subjetivo\u00bb para referirse a las facultades y
